US estate tax and ETF withholding for Canadians

Canada has one of the most generous treaties with the US. For most Canadians, US-listed ETFs are not the estate tax trap they are for Singaporeans or Indians, but the details matter.

Estate tax: the pro-rata credit

Under Article XXIX B of the Canada–US treaty, a Canadian resident gets a share of the full US unified credit, in proportion to US assets over the worldwide estate. For deaths in 2026 the full credit is $5,945,800, equal to a $15 million exemption.

In practice: if your worldwide estate is below about US$15 million, the credit usually wipes out the US estate tax. But your executor still has to file Form 706-NA if your US-situs assets exceed $60,000, or the credit can't be claimed. Any US estate tax that is due can generally be credited against the Canadian tax on the deemed disposition of those US assets at death.

Dividends: depends on the account

RRSP / RRIF0% US withholding (treaty pension exemption)
Taxable account15%, usually creditable against Canadian tax
TFSA, RESP15%, lost: not recognised by the treaty

That is why many Canadians hold US-listed ETFs in an RRSP and Canadian-listed ETFs elsewhere. Irish UCITS ETFs are less common in Canada; the fund-level 15% can't be recovered in any account, including an RRSP.

Your treaty rate is 15%, no higher than the Irish fund's 15%, so on dividends alone the UCITS ETF has no edge. Estate tax can still matter: see the estate tax calculator.
